Terms of Service

These Terms of Service ("Terms") govern your access to and use of avantevisibility.com (the "Site") and any audits, monitoring, consulting, or related services we provide (the "Services"), offered by Avante Visibility ("we," "us," or "our"). By accessing the Site, requesting a Service, or paying an invoice, you agree to these Terms.

1. The Services

We offer one-time audits (e.g., GEO / AI Visibility Audit, Review Intelligence Audit, GBP Audit, Speed Audit, Technical SEO Audit), recurring monitoring and implementation programs, and custom consulting. Specific deliverables, timelines, and fees for your engagement are described on the relevant Service page, on the checkout flow, or in a separate proposal or statement of work.

The free AI Visibility Score tool at /ai-score is provided "as is" for informational purposes only.

2. Fees, payment, and promo codes

Audit and monitoring fees are listed in U.S. dollars and are payable via the payment links provided at checkout. Promotional codes (such as GEO40) reduce the listed price by the stated amount and are valid only through the promo expiration date stated at checkout. Promo codes are not transferable, may not be combined with other discounts unless explicitly stated, and cannot be applied retroactively to past purchases.

Monitoring and other recurring services are billed in advance on a monthly cadence unless otherwise agreed. You can cancel a recurring service at any time by contacting us; cancellations take effect at the end of the then-current billing period and no refunds are issued for partial months.

3. Delivery and the 48-hour guarantee

Most audits are delivered within five business days of receipt of intake-form information and payment. Where we publicly market a "48-hour initial findings" delivery guarantee for a Service, the guarantee applies to the initial technical findings only (not the full audit) and the remedy for missing the 48-hour deadline is a full refund of the audit fee. The 48-hour window begins when we receive both your payment and the minimum intake information we request.

4. What an audit is and is not

Our audits are evidence-based, point-in-time evaluations using documented methodology, public site evidence, controlled AI query tests, and our internal scoring model (the "GEO Scoring Model"). The GEO Scoring Model is an Avante Visibility scoring framework and is not endorsed by, sponsored by, or affiliated with Google, OpenAI, Anthropic, Microsoft, Perplexity, or any other AI platform provider. Audit findings reflect observed conditions at the time of testing and may change as AI platforms, models, and indexes evolve. We do not guarantee any specific ranking, citation, traffic, or revenue outcome from implementing audit recommendations.

5. Your responsibilities

• You will provide accurate and complete intake information.
• You will not provide us with information you are not authorized to share, including third-party confidential information without permission.
• You are responsible for implementing the recommendations on your own site or designating a vendor to do so, unless implementation is explicitly included in your engagement.
• You will not use the Services in violation of applicable law, and you will not use any audit deliverable to engage in manipulative SEO, fake-review, or other prohibited tactics.

6. Intellectual property

We retain ownership of the GEO Scoring Model, audit methodologies, templates, and any pre-existing or general materials we use to produce deliverables. Subject to your full payment, you receive a non-exclusive, perpetual, worldwide license to use the deliverables we prepare for you for your internal business purposes. You may not resell, sublicense, or publicly distribute the deliverables as your own work product without our written permission.

We may use aggregated, de-identified data from engagements to improve our methodology, benchmarks, and product offerings. We may publicly reference the fact that we have worked with you only with your prior written approval.

7. Confidentiality

Each party will treat as confidential any non-public information designated as confidential or that a reasonable person would understand to be confidential. Confidential information may not be used or disclosed except as needed to perform the engagement or as required by law.

8. Disclaimers

THE SITE AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free, or that audit recommendations will produce any specific outcome.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS ($100.00).

10. Indemnification

You agree to defend, indemnify, and hold harmless Avante Visibility and its personnel from any third-party claim arising out of (a) your breach of these Terms, (b) information or materials you provide to us, or (c) your use of the Site or any deliverable in violation of applicable law.

11. Term and termination

These Terms apply for as long as you use the Site or any Service. We may suspend or terminate your access if you breach these Terms or fail to pay amounts due. Provisions that by their nature should survive termination will survive (including Sections 6–10 and 12).

12. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada for any dispute arising out of or relating to these Terms.

13. Changes to these Terms

We may modify these Terms from time to time. Material changes will be reflected by updating the "Effective date" above. Your continued use of the Site or the Services after a change takes effect constitutes acceptance of the revised Terms.
